Title 9 Investigations

Title 9 June 22, 1972

An Outsourced Solution for your Institution

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.” Title IX of the Education Amendments of 1972

Title IX of the 1972 Education Amendments requires scholastic institutions receiving federal funding to combat gender-based violence and harassment, and respond to survivors’ needs in order to ensure that all students have equal access to education. When a school knows, or reasonably should know, of possible violations, it must take immediate and appropriate action to investigate and determine what occurred. A failure to do so may result in violations ultimately resulting in a loss of federal funding. Moreover, in these times of instant news accessibility and social media presence, reputations of scholastic institutions can come under fire with just a few clicks or a post of a potential situation.

Educational institutions have all taken notice since the Department of Education’s Office for Civil Rights issued their April 2011 Dear Colleague Letter about Title IX compliance. It brought to light their Title IX responsibilities regarding instances of sexual harassment, which includes sexual violence.

It is paramount that scholastic institutions take immediate and decisive action on reports made but do so in a manner that creates an atmosphere where students, faculty and administrators feel comfortable in reporting allegations. A prompt, thorough, and impartial inquiry designed to reliably determine what occurred must be commenced immediately.
